Terms And Conditions

Please read this Terms of Use Agreement (the "Agreement") carefully. The Agreement governs your use of SupportYourCause.com ("SYC") and the services provided through this website (the "Service" or "Program"). Each time you use the Service, you acknowledge that you have read and agree to be bound by the Agreement. SYC is providing this Service to its users, not to causes. If you do not agree to be bound by the Agreement, you may not use the Service. SYC has the right to change the Agreement, in whole or in part, at any time with or without notice.

We feel so strongly about our mission that SYC will donate annually 10% of our net profit to the causes you select. The money will be allocated based upon the total percent purchased on our site by you and other users. The more you purchase on our site, the more your favorite cause receives. The calculation of net profit will be made for the period November 1 to October 31. You'll receive an e-mail from us in November or December detailing your total share and your current cause. For your cause to receive the funds, you must login to our site and confirm the information for your current cause. If you don't confirm this e-mail by December 31 of that same year, these funds may be forfeited.

User accounts will be credited, subject to this Agreement, a percentage of the net purchases made by you at one of the online merchants affiliated with SYC (an "Affiliate Merchant"). The percentage or in some cases credit amount will be detailed on the SYC Web site as it relates to each Affiliate Merchant. The net purchase is defined as the total amount paid to the merchant minus tax, gift wrapping, shipping, promotional credits, returns, cancellations, and transaction fees or as the Affiliate Merchant defines on their respective Web site and as is detailed in their respective Affiliate Usage and/or Operating Agreement document, whichever total is less. All Affiliate Merchant Usage and/or Operating Agreements as they relate to their affiliate or partner programs with SYC and which reside on the Affiliate Merchant's respective Web sites are hereby incorporated into this Agreement by reference.

To be eligible for account credit you must make a "Qualified Purchase". In order to make a "Qualified Purchase", you must satisfy the following criteria:

• Purchases made from merchants listed as "0% Reward", or "Coupons Only" will NOT be deemed a "Qualified Purchase." However if you purchase through these merchants, you will still be raising money for your cause since we donate 10% of our profit to our member causes. The more goods you purchase the higher amount your cause receives from these funds.
• First and Third Party "Cookies" must be enabled on your Web browser.
• You must make all Qualified Purchases by clicking on the "Affiliate Merchant's" link that appears on the SYC site, and be successfully connected to the Affiliate Merchant's site based on that click.
• SYC may, at all times, route your request for a merchant site through specific links, in order to assure that the sale can be tracked correctly. Any alteration of these links will invalidate your sale, which will not be deemed a Qualified Purchase.
• You must complete the "Qualified Purchase" during the same session immediately following the initial click-through to the Affiliate Merchant's site. If you start a purchase, then complete it in a different session, you will be not be making a Qualified Purchase.
• Users must not use discount codes, coupon codes or promotion codes not listed on the SYC.
• Items must not be returned. If they are, the initial purchase will be invalidated and not be deemed a Qualified Purchase.

SYC makes no guarantees that your account will be credited on purchases even if all steps are followed for a "Qualified Purchase". The determination of whether or not a purchase made through an SYC Affiliate Merchant is a "Qualified Purchase" is at the sole discretion of SYC.

Account Credit to Users are subject to adjustments for returns, cancellations, and other events. Such adjustments can be applied to user accounts at any time by SYC at its sole discretion. Should you disagree with any adjustments made to your account, your sole remedy is to withdraw from the Program. You will also be solely responsible for any and all tax liability arising out of your accrual or redemption of rewards.

It is your responsibility to check your account regularly to ensure that your account has been credited and that your account balance is accurate. If you do not believe that a purchase has been correctly credited to your account you must wait at least 30 days but no more than 90 days after completing a Qualifying Purchase to contact SYC Customer Care. Furthermore, all purchases made by Users are subject to review. In addition, SYC reserves the right to make adjustments to User accounts at any time at our sole discretion. If you disagree with any adjustments made to your account your sole remedy is to discontinue use of the Program. SYC reserves the right to terminate any account for abusive or fraudulent activity, or if the User is no longer reachable at the e-mail address provided.

In the event that an Affiliate Merchant shall withhold any portion of the fees payable to SYC on account of a Qualified Purchase, SYC reserves the right to withhold the equivalent amount from your account based on such purchase(s).

SYC is not responsible for changes to, or discontinuance of, any Affiliate Merchant, or any Affiliate Merchant withdrawal from the Program, or for any effect on accrual of rewards caused by such changes, discontinuance, or withdrawal. SYC is not responsible for changes to, or discontinuance of, any special offer or coupon code at an Affiliate Merchant site. It is the User's responsibility to make sure that all specials are valid. If you choose to use coupons and specials that are not listed on the SYC site, we cannot guarantee that you will be eligible to receive an SYC reward on your purchases. SYC is not responsible for tracking problems resulting from incorrect usage of SYC, disabling cookies, computer issues resulting from unknown causes such as third-party software or other issues, merchant partner errors/omissions or from any other failure of tracking mechanisms.

At all affiliate merchants, the following purchase are not eligible for account credit: gift certificate purchases, RX prescriptions, pet prescriptions, extended warranty products, monthly delivery products such as "auto-ship" products and "wait-list" items. We cannot, however, give Donation Credit for taxes, shipping, or any portion of a purchase that is paid for with coupons, gift certificates or a store credit. Any purchase of products and services in which the transaction is substantially completed by telephone does not qualify. Purchases made online but picked up at the merchant store do not qualify. Any order for a merchant catalog is not eligible. Wine-of-the-month clubs, monthly pet food deliveries and telephone service packages are not eligible unless all months are paid for up front through Support Your Cause. Purchases of prescription medications are not eligible. We cannot ensure that credit will be earned if Google Checkout is used as the method of payment for your purchase. Purchases for airplane tickets do not qualify

In addition, certain stores have items that are not eligible. See Merchant Exception Section below for details.

Barnes & Noble.com: Purchases made through the "PC & Video Games" (GameStop.com) area of Barnes & Noble.com are not eligible. Video games and downloadable articles are also not eligible.

Blue Nile: A maximum of $375.00 Donation Credit can be earned for purchases at Blue Nile.

Buy.com: Purchases in the "Cellular" category are not eligible.

Carrot Ink: Laser Toner products and OEM Brand-name Products such as Genuine HP are not eligible.

Cooking.com: All All-Clad products are not eligible for Cash Back.

Dell Computers: Any purchase of Dell products and services in which the transaction is substantially completed by telephone or by a Dell salesperson, or any purchase of refurbished goods. Any orders placed through the Dell Business Alliance Systems Division, State & Local Government, Federal Government, Education, Healthcare, Medium & Large Business, Emerging Business and Internet Service Provider Divisions are not eligible for Cash Back rewards. Please be aware that Dell is unable to track orders that are made by linking between business units. If you click on Dell Home, Dell Home Software and Peripherals or Dell Small Business, the purchase needs to be made within that business unit. If you find that you have navigated away from the intended site or you wish to access other areas of the Dell Site, return to the Support Your Cause home page and choose the appropriate link for the purchase.

Disneyshopping: DisneyWorld park passes are not eligible.

Drugstore.com: Vision Direct purchases from Drugstore.com are not eligible.

Enterprise Rent-A-Car: Purchases of automobiles at Enterprise do not qualify to earn Cash Back rewards. Cash back will post to your account within 21 days of the completion of your rental use.

Expedia: Credit on Expedia purchases may not appear in your account until after your travel dates have passed. Also, purchases of 'WebFare' travel and Expedia Corporate Orders do not qualify.

Hallmark: Stamps, gift boxes and gift cards are not eligible.

Hotels.com: Credit may not show in your account until 35 days after your travel has been completed.

LetsTalk.com: Accessories purchases of do not qualify.

Macy's: Purchases at Macy's "Wedding Channel" do not qualify.

Netflix: Purchases of gift subscriptions do not qualify to earn Cash Back.

Office Depot: Purchases made at the Business Services Division of Office Depot are not eligible.

Orbitz: Purchases on Activities are not eligible.

Overstock: Travel purchases at Overstock are not eligible.

PaylessShoeSource: in-store pick-up purchases do not qualify to earn Cash Back.

PCConnection: Existing PC Connection Customers using their Internet Business Accounts for the purchase are not eligible.

Proactiv Solutions: Catalog purchases do not qualify.

Sears: Purchases made on Sears auctions or at any licensed partners, gifts cards, and Lands End merchandise are not eligible.

Sharper Image: purchases of iPods do not qualify.

Sony: Purchases of car audio products are not eligible.

Tivo: Purchases of accessories do not qualify.

Payments are distributed to your causes quarterly on or around February 15th, May 15th, August 15th, and November 15th. All checks are paid in U.S. dollars. You must have accrued $25 of credit in your account for a check to be issued. If you have less than $25, the credit amount rolls over to the next scheduled payment period. In order for an accrued purchase credit to be eligible for payment on the above dates, the Qualified Purchase must occur 45 days prior to the payment date. <<>> In addition, "Bonus Rewards" such as the Tell A Friend credit or Sign Up credit do not count towards this minimum.

Prior to issuing quarterly checks, Support Your Cause may email you to verify and confirm which cause you want to receive the check. You will need to verify the information by returning to the site to confirm prior to the above check disbursement dates. If a verification confirmation is not received back from you by the check disbursement date, the check may not be issued and may roll over to the next scheduled payment period. <<>> If an error occurs in payment, SYC Customer Service will assist Users in determining the cause of any non-payment. If it has been determined that non-payment was caused by a process error in payment automation or other cause that was our fault, all accrued credits will be re-paid to you in full. However, SYC is not responsible for any misapplied payments or checks sent to the wrong address and subsequently cashed if these errors were caused by inaccurate contact information provided by the user. We are also not liable for errors made by outside entities in applying your payment, though we will work hard to resolve any such issues should they arise.

Funds earned through Bonus Rewards will be paid along with Qualifying Purchase Rewards. Continued payments of Bonus Reward credits will be made at the sole discretion of SYC. The Tell A Friend Program be ended, percentages reduced or the program modified in any way, at any point, and without notice.

Participation in the Program is limited to individuals that are 18 years or older.

Any attempt to accumulate account credit by means of an automated machine or computer, scripts, software computerized or automated process, or through the use of multiple accounts is expressly prohibited. SYC will cancel a user's account and that user will forfeit all credit earned if they are found to be manipulating the system. SYC reserves the right to pursue such prohibited conduct to the fullest extent of the law. User must maintain a maximum one unique account and any duplicate accounts are subject to cancellation.

The Program is currently offered for purchases made through links on the SYC web site. You must have Internet access and a valid working email address to receive the privileges and benefits of participation in the Program. SYC is not responsible for your inability to connect to the Internet, log into the SYC Web site, or access your SYC account.

You also agree not to "spam" other individuals to join the SYC program via unsolicited email, direct mail, newsgroups, message boards, or other means. We reserve the right to remove a member from the Program if they are found to be "spamming". It is the sole discretion of SYC to determine if a user is "spamming". Refusal to abide by this or any other rules may result in but is not limited to SYC stripping you of referral bonus rewards, canceling your account, and/or eliminating your account balance. Your number of referral bonus rewards per month will be limited to 5 separate individuals.

SYC also provides online coupons as a free service to its users. These online coupons are entered in by our staff. SYC is not responsible for the redemption, errors/omissions or expiration of online coupons and it is the user's responsibility to make sure that a discount, % off, special pricing, or free offer is present in the checkout process of an Affiliate Merchant. Coupons are generally not valid with any other offer from a specific merchant unless otherwise noted.

All offers and promotions on this site are subject to change without notice. SYC provides a venue for obtaining the information contained in this site and has no control over the legality of any coupons or other offers made by affiliate merchants, the ability of any of the affiliate merchants to complete the sales in accordance with the offers, or the quality of the goods offered by the affiliate mercants. Mr. Rebates has no control over whether affiliate merchants will honor the offers shown on this site and does not guarantee the accuracy or completeness of the information contained in this site. In the event you have a dispute with an affiliate merchant in any way relating to this site or the use of information from this site, you agree to waive and SYC from any and all claims, demands, actions, damages (actual and consequential), losses, costs or expenses of every kind and nature, known and unknown, disclosed and undisclosed relating to that dispute.

The information on this website may contain typographical errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have made a Qualified Purchase). Please note that such errors, inaccuracies or omissions may relate to product pricing and Qualified Purchase credit by store. The final price of a product is determined at the Affiliate Merchant's website. Neither SYC nor the Affiliate Merchant in question are not liable for any pricing errors.

In addition, SYC posts rebate credits by store in various sections of the website. While SYC makes every effort to post accurate information as intended, any individual rebate credit displayed on SYC is subject to change and revision for accuracy. SYC is is not liable for any mistakenly displayed Qualified Purchase credit by store. Under no circumstances for any single Qualified Purchase will a Qualified Purchase credit exceed 25% or $50.

You authorize SYC to disclose to third parties information you have provided, or information that SYC has obtained about your SYC account or shopping behavior: 1) to agents and licensors of SYC or its affiliates, such as independent auditors, consultants or attorneys; 2) to comply with government agency or court orders or requests; 3) in providing aggregated and non-personalized marketing services for an advertising or merchant partner, or 4) where it is necessary for redemption or transfer of your account credit. Further, you authorize SYC to receive any account information from any Affiliate Merchant including, but not limited to information regarding purchase was made, products ordered, order number, the time and date the purchase occurred, the email address entered for the purchase. You agree to hold the Affiliate Merchant harmless for any information disclosed to SYC.

By using the SYC Service, you agree to receive communications that are account and Usage related (e.g. that we've added funds to your account, that we are disbursing a check on a certain date, that new features are available on the SYC site, etc) as well as periodic shopping-related emails that highlight coupons & special deals that are available to SYC Users. You can opt-out of receiving emails that are not account-related by either 1) visiting your account page and hitting the 'click here to edit your profile' link, or 2) following the unsubscribe link on any of the emails. Since we need to communicate account information with you in order to operate our service, you can't unsubscribe from account information emails. These are only used to notify you that we put funds in your account, that we mailed a check and it came back to us as having a bad address, and so forth. If you don't wish to ever hear from us, even if just to hear that we tracked your purchase and credited your reward, you can close down your account by contacting customer service.

Account credits are non-transferable between members and are void if transferred. User's membership will terminate immediately in the event of Member's death. Account credits may not be bartered or sold. SYC accounts and account credits are not transferable upon death or as part of a domestic relations matter or otherwise by operation of law.

THE SYC PROGRAM ARE BEING PROVIDED TO USERS "AS IS" WITH NO WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYC DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PROGRAM AND THE SOFTWARE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.

SYC DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE QUALITY OF, OR ACCURACY OF ADVERTISEMENTS FOR, ANY MERCHANDISE, PRODUCTS, OR SERVICES OFFERED OR PROVIDED BY AFFILIATE MERCHANTS OR SUPPLIERS IN CONJUNCTION WITH THE PROGRAM. IN ADDITION, ALTHOUGH SYC INTENDS TO TAKE REASONABLE STEPS TO PREVENT THE INTRODUCTION OF VIRUSES OR OTHER DESTRUCTIVE MATERIALS TO THE SYC WEB SITE, SYC DOES NOT WARRANT, GUARANTEE OR MAKE ANY REPRESENTATIONS THAT THIS SITE IS FREE OF DESTRUCTIVE MATERIALS. YOU AGREE NOT TO SUE ANY CORPORATE PARTICIPANT FOR NON-PERFORMANCE BY SYC. IN NO EVENT SHALL SYC BE LIABLE FOR ANY DAMAGES, CLAIMS OR LOSSES INCURRED (INCLUDING WITHOUT LIMITATION COMPENSATORY, INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES), HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY ARISING IN CONNECTION WITH: THE PROGRAM; ANY FAILURE, DELAY, OR DECISION BY SYC IN ADMINISTERING THE PROGRAM; THE USE OR INABILITY TO USE THIS WEB SITE; OR THE PURCHASE OR USE OF ANY MERCHANDISE, PRODUCTS, OR SERVICES OF MERCHANTS OR SUPPLIERS, EVEN IF SYC, OR REPRESENTATIVES THEREOF, ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, CLAIMS, OR LOSSES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

USER AGREES TO INDEMNIFY AND HOLD SYC, ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF MEMBER'S USE OF THE PROGRAM, THE VIOLATION OF THESE POLICIES BY MEMBER, OR THE INFRINGEMENT BY MEMBER, OR OTHER USER OF THE PROGRAM USING THE MEMBER'S ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY, OR AS A RESULT OF ANY THREATENING, LIBELOUS, OBSCENE, HARASSING OR OFFENSIVE MATERIAL CONTAINED IN ANY MEMBER COMMUNICATIONS.

UNDER NO CIRCUMSTANCES, SHALL SYC OR ANY OF THEIR EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS OR SUPPLIERS BE LIABLE FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THIS WEBSITE.

THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND (WHETHER GENERAL, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INCOME OR PROFITS), WHETHER IN CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, EVEN IF AN AUTHORIZED REPRESENTATIVE OF ANY SYC CORPORATION BUSINESS HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH THIS WEBSITE OR ANY CONTENT ON THE SITE, OR WITH THESE TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THIS WEBSITE. YOU ACKNOWLEDGE, BY YOUR USE OF THIS WEBSITE, THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OF LIABILITY SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. IF ANY PART OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF THE TARGET CORPORATION BUSINESSES UNDER SUCH CIRCUMSTANCES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).

SYC reserves the right to terminate the Program at any time with notice. In the event the Program is terminated, you will have sixty (60) days from the date notice of Program termination is provided to Users to redeem credits in your account. Notification of Program termination will be sent to the email address you provide to SYC during the registration process. SYC will not be responsible for failing to notify you of Program termination where such failure is caused by any reason outside the control of SYC, including an error in your email program, an inaccurate email address, your failure to check for your email online, or your failure to inform SYC of a change in your email address.

You may cancel your account at any time by using the account interface on the web site to cancel your account. Immediately upon cancellation, your account will be closed. YOU UNDERSTAND AND AGREE THAT UPON CLOSING YOUR ACCOUNT, YOUR RIGHT TO PARTICIPATE WILL CEASE AND ALL CASH BACK REBATES IN YOUR ACCOUNT AT SUCH TIME, HOWEVER AND WHENEVER ACCUMULATED, WILL BE FORFEITED.

SYC may modify this Agreement from time to time, with or without notice, and your continued participation in the Program after such modification shall be deemed to be your acceptance of any such modification. It is your responsibility to check the Member Agreement page of the SYC Web site regularly to determine whether this Agreement has been modified. If you do not agree to any modification of this Agreement, you must immediately cease participation in the Program.

Usage in the Program is subject to the Program Terms and Conditions. Any failure to comply with the Program Terms and Conditions, any fraud or abuse relating to the accrual or redemption of rewards, or any misrepresentation of any information furnished to SYC or its affiliates by you, or anyone acting on your behalf, may result in the termination of your Usage in the Program, cancellation of your SYC account and/or forfeiture of your accrued rewards. SYC also reserves the right to close accounts that have been inactive for more than 12 months "Dead Accounts". Inactivity is defined as no tracked visits, either cookied or manually logged in. Any Dead Account will have all funds in it taken back by SYC, and we will no longer allow user login under that username and password. If you haven't come by in a year, and haven’t responded to any of our emails over the course of a year, SYC will close the account and take back any funds therein.

All questions or disputes regarding the Program, including without limitation, questions or disputes regarding eligibility for the Program, or the eligibility of rewards for accrual or redemption, must be submitted in writing within 60 days of the qualifying transaction, to SYC at: Customer Service, SupportYourCause.com, PO Box XXXX, Emeryville, CA 94608, or contact Customer Care. Any such disputes shall be resolved by SYC at its sole discretion. All interpretations of Program Terms and Conditions shall be at the sole discretion of SYC. In the event that an error is made by SYC, your sole remedy shall be the credit of the disputed reward to your SYC account.

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without reference to conflicts of law rules. As a condition of the use of the SYC website and service, you (the User) agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Alameda, California and therefore agree to file any grievance or suit of any kind exclusively in the courts located within the county of Alameda. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. SYC' failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between SYC and the Affiliate Merchants or between SYC and any other of its Corporate Partners. Neither the Affiliate Merchants nor any Corporate Partner shall have the ability to create any obligation on SYC' behalf. This Agreement constitutes the entire agreement between you and SYC with respect to the Program.
